Returns and Refunds Policy
Our goal is to ensure your complete satisfaction.
The Customer must inspect the order upon receipt and contact the Seller immediately in case of defects or damage or if they have received the wrong item. This way, we can assess the problem and make sure to resolve it.
In any case, if, for any reason, only the "Consumer natural person" Customer is not satisfied with their order, they can exercise the right of withdrawal, also known as the "right of reconsideration", regulated by the Consumer Code (Articles 52 et seq. Legislative Decree 206/2005) and return the purchased products. For this point, please refer to Chapter 6 of the General Terms and Conditions of Sale.
In accordance with the provisions of this Returns Policy, the Customer must inform Archivio Miroglio (Seller) of their decision to exercise their right of withdrawal within 14 calendar days from the date they received the product purchased on www.archiviomiroglio.com.
To exercise their right of withdrawal and/or return, the Customer must:
a) send an email to info@archiviomiroglio.com, specifying whether their decision to withdraw from the contract and return the products is a consequence of:
i) a manufacturing defect and/or non-conformity of the product: for all information on this point, please refer to Article 5 "Product Conformity and Guarantees" of the General Terms and Conditions of Sale;
or
ii) exercising the right of withdrawal, also known as the "right of reconsideration," within 14 calendar days of receiving the item: for all information on this point, please refer to Article 6 "Right of Withdrawal of the Consumer Customer" of the General Terms and Conditions of Sale;
b) provide in the aforementioned email the details related to the date of receipt of the products, the order number, their full name, and the email address of the account associated with the order.
In case of omission of any of the data in the aforementioned email (as detailed above), we may not be able to process your return request.
The Seller will send a confirmation of receipt of your return request to the email address of the account associated with the order, which will also contain instructions for returning the product.
Conversely, in the case of returns following the exercise of the "right of reconsideration," the products must be returned by shipping the package with the carrier chosen by the Customer and at their expense.
Returned items must be shipped back to the Seller within fourteen (14) calendar days from the date on which the Customer notified the Seller of their decision to exercise their right of withdrawal.
Returns must be shipped to the following address: Archivio Miroglio srl, Piazza Carlo e Franco Miroglio 7, 12051 Alba (CN).
Items sent without a prior return request will not be accepted.
Terms and Conditions for Exercising the Right of Withdrawal, also known as the "Right of Reconsideration"
The right of withdrawal, also known as the "right of reconsideration" (and the subsequent return of products purchased on www.archiviomiroglio.com), will be considered correctly exercised if the following conditions are met:
sending an email to info@archiviomiroglio.com stating the desire to withdraw from the online sales contract and providing all data in accordance with the above requirements, strictly within fourteen (14) calendar days of receiving the products;
as for clothing items, they must not have been used or worn in a way other than what is necessary to establish the nature, characteristics, and functioning of such products, nor washed, and, in any case, they must comply with the requirements better defined in the section on conformity checks in the following section;
the identification tag, which is an integral part of the item, must not have been removed;
the returned products must be returned in their original packaging;
the products must not be damaged;
the returned products must be delivered to the courier within fourteen (14) calendar days from when the Customer received the return acceptance email from the Seller.
The Seller does not accept returns of items purchased "on promotion" or with "gift vouchers."
Conformity Checks
Our products must be returned unused and new, in perfect condition and complete with all protective materials, with any labels and tags attached, and including all accessories and documents. We reserve the right to:
not accept the return if the products show signs of wear, or have been used or altered in any way from their original condition in a way other than what is necessary to establish their nature, characteristics, and functioning,
or, alternatively,
reduce the refund amount if the product's handling by the Customer has caused a decrease in its value. For example, we reserve the right to make a reduction in the refund amount if:
the products have been used, worn in a way other than what is necessary to establish their nature, characteristics, and functioning, or damaged or washed;
the identification tag was not attached to the product (or products) or was not returned. The identification tag is an integral part of each product;
the packaging, which is an integral part of the product, was also not returned.
We will inform the Customer if their return request is not accepted because the returned products do not comply with the conditions indicated in the previous paragraph "Terms and Conditions for Exercising the Right of Withdrawal." In such a scenario, the exercise of the right of withdrawal will have no effect, and the Seller will send the previously purchased products back to the Customer. To receive the originally purchased product, consumers residing outside the European Union authorize, as of now and if necessary, the Seller to return the product outside the European Union, as (where necessary) will be specified in the communication informing you of the rejection of your return request. The re-shipment of the product will be at the customer's expense.
The Seller will also inform the Customer if it is necessary to reduce their refund because the returned products do not comply with the conditions indicated in the second paragraph of the previous section (Conformity Checks). In this case, the Customer may (as an alternative to the reduced refund) choose to have the products sent back to them. The re-shipment of the products will be at the Customer's expense. If this option is refused, the Seller reserves the right to retain the products and the amount indicated for the reduction of the refund, due to the reduced value of the returned products.
Refund Times and Methods
The Seller, as soon as it has received and inspected the return, will send the Customer an email with a specific communication to inform them whether the refund has been approved or not. In this case, the Seller will fully refund the Customer the price of the purchased products, including taxes.
If the return is approved, within fourteen (14) working days from the receipt of the returned product, the Seller will issue the refund of the price through the payment method originally used.
Since the technical times required by the bank or the credit card issuing company to process and make the refund visible to the Customer may be longer, if more than thirty (30) working days have passed from the date of return of the item, without having received the agreed refund, the Customer can contact the Seller at info@archiviomiroglio.com.
Shipping Costs for Returning Products to the Seller
In case of product returns due to the exercise of the Right of Withdrawal, also known as the "right of reconsideration," shipping costs will always be borne by the Customer.
If the product return is due to defects in conformity, the Customer will not be required to bear any costs, as the legal guarantee of conformity applies.
