Returns and Refunds Policy

Our goal is to ensure your full satisfaction.

The Customer must inspect the order upon receipt and contact the Seller immediately in case of defects, damages, or if the wrong item was received. This will allow us to evaluate the issue and take steps to resolve it.

In any case, if for any reason the "Natural Person Consumer" Customer is not satisfied with their order, they may exercise the right of withdrawal (the so-called "right of rethinking") governed by the Consumer Code (Art. 52 et seq. of Legislative Decree 206/2005) and return the purchased products. On this point, please refer to Section 6 of the General Terms and Conditions of Sale.

In accordance with the provisions of this Return Policy, the Customer must inform Archivio Miroglio (the Seller) of their decision to exercise the right of withdrawal within 14 calendar days from the date they received the product purchased on www.archiviomiroglio.com.

To exercise the right of withdrawal and/or return, the Customer must:

a) Send an email to info@archiviomiroglio.com, specifying whether the decision to withdraw from the contract and return the products is due to:

  • i) A manufacturing defect and/or product non-conformity: for all information on this point, refer to Art. 5 "Product Conformity and Warranties" of the General Terms and Conditions of Sale;

    OR

  • ii) Exercise of the "right of rethinking" within 14 calendar days from receipt of the goods: for all information on this point, refer to Art. 6 "Right of Withdrawal of the Consumer Customer" of the General Terms and Conditions of Sale;

b) Provide in the aforementioned email details regarding the date of receipt of the products, the order number, their first and last name, and the email address of the account associated with the order.

In the event of omission of any of the data in the email (as detailed above), we may not be able to process the return request.

The Seller will send a confirmation of receipt of the return request to the email address associated with the order, which will also contain instructions for returning the product.

In the case of returns following the exercise of the "right of rethinking," the products must be returned by shipping the package using a carrier of the Customer's choice and at their own expense.

The items subject to return must be sent back to the Seller within fourteen (14) calendar days from the date the Customer communicated their decision to exercise the right of withdrawal.

Returns must be shipped to the following address: Archivio Miroglio srl, Piazza Carlo e Franco Miroglio 7, 12051 Alba (CN), Italy.

Items sent without a prior return request will not be accepted.

Terms and Conditions for the Exercise of the "Right of Rethinking"

The right of withdrawal (and the subsequent return of products purchased on www.archiviomiroglio.com) will be considered correctly exercised if the following conditions are met:

  • Submission via email to info@archiviomiroglio.com of the declaration to withdraw from the online sales contract along with all required data strictly within fourteen (14) calendar days from receipt of the products;

  • Regarding clothing items, they must not have been used or worn beyond what is necessary to establish the nature, characteristics, and functioning of such products, nor washed, and must comply with the requirements defined in the Conformity Checks section below;

  • The identification tag, which is an integral part of the item, must not have been removed;

  • The returned products must be returned in their original packaging;

  • The products must not be damaged;

  • The returned products must be delivered to the carrier within fourteen (14) calendar days starting from when the Customer received the return acceptance email from the Seller.

The Seller does not accept the return of items purchased "on promo" or with "gift vouchers."

Conformity Checks

Our products must be returned unused and new, in perfect condition, complete with all protective materials, with any labels and tags attached, and including all accessories and documents. We reserve the right to:

  • Refuse the return if the products show signs of wear, or have been used or altered in any way from their original condition beyond what is necessary to establish their nature and functionality;

    OR, alternatively

  • Reduce the refund amount if the Customer's handling of the product has caused a decrease in its value. By way of example, we reserve the right to reduce the refund if:

    1. The products were used or worn beyond testing, or were damaged or washed;

    2. The identification tag is not attached or was not returned (the tag is an integral part of each product);

    3. The packaging, which is an integral part of the product, was not returned.

We will inform the Customer if the return request is not accepted because the products do not comply with the conditions mentioned above. In this scenario, the withdrawal will have no effect, and the Seller will send the products back to the Customer. To receive the original product, consumers residing outside the European Union authorize the Seller to return the product outside the EU, with shipping costs charged to the customer.

If a reduction in the refund is necessary due to non-compliance, the Customer may choose (as an alternative to the reduced refund) to have the products sent back at their own expense. If this option is refused, the Seller reserves the right to retain the products and the amount indicated for the refund reduction.

Refund Timing and Methods

As soon as the Seller receives and inspects the return, an email will be sent to inform the Customer whether the refund has been approved. If approved, the Seller will refund the full price of the products, including taxes.

The refund will be issued within fourteen (14) business days from receipt of the returned product, using the original payment method.

Since the technical time required for the bank or credit card company to process the refund may be longer, if more than thirty (30) business days have passed since the return date without receiving the refund, the Customer may contact the Seller at info@archiviomiroglio.com.

Shipping Costs for Returning Products to the Seller

In the case of a return for the "right of rethinking," shipping costs are always at the Customer's expense.

If the return is due to lack of conformity (defects), the Customer will not bear any costs, as the legal guarantee of conformity applies.
