Return and Refund Policy
Our goal is to ensure full Customer satisfaction.
The Customer must inspect the order upon receipt and contact the Seller immediately in the event of defects or damage, or if the wrong item was received.
In any case, if, for any reason, the “Individual Consumer” Customer is not satisfied with their order, they may exercise their right of withdrawal, known as the “right of reconsideration,” governed by the Consumer Code (Art. 52 et seq. of Legislative Decree 206/2005) and return the products via their account. In this regard, please refer to Chapter 6 of the General Terms and Conditions of Sale. In accordance with the provisions of this Return Policy, the Customer must exercise their right of withdrawal within 14 calendar days from the date on which they received the purchased product (or, in the case of multiple purchases, from the date on which they received the last product).
If the decision to withdraw from the contract and return the products is instead the result of a manufacturing and/or conformity defect of the product, the Customer must write to info@archiviomiroglio.com (for full information on this point, please refer to Art. 5 “Product Conformity and Warranties” of the General Terms and Conditions of Sale), providing in said email the details regarding the date of receipt of the products, the order number, their full name, and the email address of the account associated with the order. If any of the data within the aforementioned email (as detailed above) is omitted, we may be unable to process your return request.
The Seller will send a confirmation of receipt of your return request to the email address of the account associated with the order, which will also contain instructions for returning the product.
Only in the case of returning products that have manufacturing or conformity defects (activation of the Legal Warranty), shipping costs will be borne by Archivio Miroglio.
Otherwise, in the case of returns following the exercise of the “right of reconsideration,” products must be returned by shipping the package via a carrier chosen by the Customer, with costs borne by the Customer.
The items to be returned must be sent back to the Seller within fourteen (14) calendar days from the date on which the Customer notified the Seller of the decision to exercise the right of withdrawal.
Returns must be shipped to the following address: Archivio Miroglio srl, Piazza Carlo e Franco Miroglio 7, 12051 Alba (CN).
Items sent without a prior return request will not be accepted.
Terms and conditions for exercising the right of withdrawal, known as the “right of reconsideration”
The right of withdrawal, or “right of reconsideration” (and the subsequent return of products purchased on www.archiviomiroglio.com), shall be considered correctly exercised if the following conditions are met:
return request by the Customer via their account at https://account.archiviomiroglio.com, by accessing the order and clicking the “Return items” button;
regarding clothing items, they must not have been used or worn in any way other than what is necessary to establish the nature, characteristics, and functioning of said products, nor washed, and in any case, they must comply with the requirements better defined in the conformity checks section referred to in the following section;
the identification tag, which is an integral part of the item, must not have been removed;
the products to be returned must be returned in their original packaging;
the products must not be damaged;
a copy of the invoice received or proof of purchase must be attached;
the products to be returned must be delivered to the carrier within fourteen (14) calendar days starting from when the Customer received the return acceptance email from the Seller.
Exceptions / non-returnable items
Certain types of items cannot be returned, such as custom-made products (e.g., special orders or personalized items) and personal care products (e.g., beauty products).
Conformity checks
Products must be returned unused and new, in perfect condition, and complete with all protective materials, with any labels and tags attached, and including all accessories and documents. The Seller reserves the right to:
not accept the return if the products show signs of wear, or have been used or altered in any way from their original condition other than what is necessary to establish the nature, characteristics, and functioning of the same;
or, alternatively,
reduce the refund amount if the Customer's handling of the product has caused a decrease in its value. By way of example, we reserve the right to reduce the refund amount if:
the products have been used, worn in a way other than what is necessary to establish their nature, characteristics, and functioning, or have been damaged or washed;
the identification tag is not attached to the product(s) or has not been returned. The identification tag is an integral part of each product;
the packaging—which is an integral part of the product—has not been returned.
The Seller will inform the Customer if the return request is not accepted because the returned products do not comply with the conditions indicated in the previous paragraph “Terms and conditions for exercising the right of withdrawal.” In this scenario, the exercise of the right of withdrawal will have no effect, and the Seller will ship the previously purchased products back to the Customer, with shipping costs borne by the Customer. In order to receive the originally purchased product, consumers residing outside the European Union hereby authorize, if necessary, the Seller to return the product outside the European Union, as will be (if necessary) better specified in the communication by which we will inform you of the rejection of your return request.
The Seller will also inform the Customer if it is necessary to reduce their refund because the returned products do not comply with the conditions indicated in the second paragraph of the previous section (Conformity checks). In this case, the Customer may (as an alternative to the reduced refund) choose to have the products sent back. The reshipment of the products will be at the Customer's expense. If this option is refused, the Seller reserves the right to retain the products and the amount indicated for the refund reduction due to the reduced value of the returned products.
Refund times and methods
As soon as the Seller has received and inspected the return, they will send the Customer an email to inform them whether the refund has been approved or not. If approved, the Seller will fully refund the Customer the price of the purchased products, including taxes. Shipping costs will be refunded to the Customer only in the event of product conformity defects.
If the return is approved, within fourteen (14) business days of receiving the returned product, the Seller will issue the refund of the price using the payment method originally used.
Since the technical times required by the bank or the credit card issuer to process and display the refund to the Customer may be longer, if more than thirty (30) business days have passed since the return date without having received the agreed refund, the Customer may contact the Seller at info@archiviomiroglio.com.
Shipping costs for returning products to the seller
In case of returning products for exercising the Right of withdrawal, known as the “right of reconsideration,” shipping costs will always be borne by the Customer.
In the event that the product return is performed due to conformity defects, the Customer will not be required to bear any costs, as the legal warranty of conformity applies.
Exchanges
The Seller does not perform exchanges of items purchased online at www.archiviomiroglio.com.
